Wrongful Death Cases

No one is ever prepared for the loss of a loved one; however, the loss can be compounded when the death is caused by the carelessness of others. If you have lost a loved one due to the actions of another, you have our deepest sympathies. No one outside of your family can understand your sense of loss, and we will not pretend to do so. However, we have helped many people navigate the complicated legal process, which hopefully will in some small way, begin the closure process.

Wrongful Death Case Process

We have handled death cases resulting from automobile collisions, drunk driving, and medical malpractice. Wrongful death claims are subject to court-approval prior to settlement. That means that there will have to be a hearing before a circuit court judge to finish the case and approve any settlement.

Damages in a Wrongful Death Case

Surviving family members can recover for financial losses, including expected loss of income, services, protection, assistance and care. Survivors may also recover for medical expenses of the deceased incurred incident to the injury causing the death and reasonable funeral expenses. Our law firm will seek every possible source of recovery on your behalf.

When you work with our firm, we will locate all potential sources of recovery, including insurance policies and any potential assets owned by the defendants. Usually this is the biggest issue in a wrongful death case, since most of the time the available insurance coverage is simply inadequate to cover the loss. In all aspects of your case, whether liability, damages, or source of recovery, you can be sure that our attorneys will provide compassionate, effective, and professional representation.

Can I File a Wrongful Death Lawsuit?

Only a personal representative of the deceased's estate may file a wrongful death case. The personal representative may be an executor or administrator who has properly qualified with the court. We can assist you with this process.

The unexpected death of a spouse, parent or child can bring on overwhelming sadness and concern. It is not possible to place a dollar figure on these feelings. Unfortunately, civil remedies can only provide money damages to survivors. We agree that this is a wholly inadequate remedy, but promise you and your family that we will aggressively pursue your claim to the fullest extent of the law.
